In the great state of Massachusetts employers will soon enter a new fencing match with job seekers who are at the stage of a job offer. A law going into effect next year will prohibit employers from asking prospective hires about their salary histories until they make a job offer that includes compensation. The law also provides that employers must pay men and women the same way when they do the exact same work and for when it is comparable.

This is certainly going to level the playing field. Employers currently can adjust offers if someone has lower current compensation history than another individual. Of course, the converse is true, but what the lawmakers are going for is to stop discriminatory compensation practices that historically have penalized women and minorities, and carry forward lower compensation for those groups throughout their careers.

We will want to watch this carefully because there is a good chance that the Massachusetts law may spread across the land.
