The city filed three post-trial motions alleging litigation fraud against de la Fuente, who won the huge judgment in a case he filed alleging the city's breach of contract caused him financial ruin because of the failure of his Border Business Park.

San Diego Superior Court Judge Raymond Ikola will consider a request for new trial at a hearing on Sept. 13.

New evidence that de la Fuente allegedly withheld during trial has come to light, according to the city's outside counsel, Latham & Watkins.
