The Everett Public Facilities District, created specifically to build the arena, has filed suit to block a voter initiative that would prohibit the district from building the facility at Hewitt Avenue and Broadway.

Members of the Citizens for a Better Arena filed the initiative because they say they feared the historical integrity of Hewitt would be lost, along with many historical buildings, in order for arena construction to occur. Buoyed by nearly 3,000 petition signatures, the measure would require a public vote on April 23, unless a judge strikes it down.

In the complaint, members of the PFD say the initiative came about only after $17 million had already been spent, by the city and the PFD, on land, project design and required permits. The arena is scheduled to be built by September 2003. Its anchor tenant, the Western Hockey League has plants to start an Everett franchise.
