Nelson and the city worked out a consent judgment for the development after the city refused to grant retail zoning for the property, saying it should remain zoned industrial.

The case went as far as the Michigan Court of Appeals.

The judgment kept the zoning at industrial, but allowed retail uses.

Now, Nelson wants to build a 25,000-sf to 50,000-sf medical office building on a lot at the site.

The city said he must request an amendment to the consent judgment to rezone a portion of the property to low-rise office designation.

He also wants to replace the main sign for the building, and is asking to allow the replacement.
