Town administrator Robert Fennessy tells GlobeSt.com that the deal goes back about three years ago when the land, which had an agricultural designation, was sold. That designation provides the town with the right to match any other offer made on the property.

Fennessy says that the town is contending that the owner of the property did not notify the town about the sale. When asked why the town did not file suit earlier Fennessy notes that the issue "just recently came to light."
