The developer is filing for a comprehensive permit under the state's Chapter 40B affordable housing law which allows it to bypass local zoning laws if the project has at least 25% affordable housing and the town has less than 10% of its housing affordable. Scituate has about 4.5% of its housing affordable.

Pulte Homes has submitted an application to the town and has held its first public meeting. A town representative tells GlobeSt.com that at the meeting residents were not "welcoming" the development. But if a town's zoning board does deny a 40B project a permit, it is only in rare circumstances that the state upholds that decision.
