The case the court ruled on was Colorado Criminal Justice Reform Coalition v. Ortiz, No. 03 CV 7725.This was the second victory for the state on the issue. In late December, the court also ruled that the new law does not violate the single-subject requirement provision of the state constitution.

Salazar's office defended the constitutionality of legislation (HB 03-1256) in a lawsuit brought by the Colorado Criminal Justice Reform Coalition alleging the new law violated the single-subject rule and the TABOR provisions of the state constitution in authorizing lease-purchase agreements to facilitate the construction of a new state prison in Fremont County and University of Colorado Health Sciences Center facilities at the former Fitzsimons Army base.

The $4.3 billion Fitzsimons will include the University of Colorado Health Sciences Center, Children's Hospital, and possibly the Veteran's Administration Hospital. It also includes a fledgling bioscience center.
