When the builder went bankrupt, the bank learned that its lein was subordinate to the vendee liens of the purchasers of the builder's homes.
Partner Louis Colagreco Jr. says the firm has no comment, but lawyers in and outside the litigation suggest that vendee liens are tricky for real estate attorneys because they are not recorded unless the deposit documents are registered.
