NEW YORK CITY- The Real Estate Board of New York, the Community Housing Improvement Program and the Rent Stabilization Organization have interceded in a class action suit that seeks rental refunds from landlords whose properties went dark or lacked heat or other essential services during Hurricane Sandy.
The three powerful trade groups filed an amicus brief in New York State Supreme Court last Friday supporting the defendant landlord's motion to dismiss the suit, stating that allowing the litigation to proceed would set a “dangerous precedent” in landlord-tenant relations, according to The Real Deal.
“Conditions in three apartment buildings in New York City are certainly not 'typical' of post-Sandy conditions in the thousands of residential units located across the state of New York,” the brief states. See story in The Real Deal.
