EAST RUTHERFORD, NJ-A State Superior Court Judge refused to dismiss a case filed by the Giants and Jets against Triple Five, the developer of the troubled American Dream Meadowlands project and the New Jersey Sports and Exposition Authority.
Judge Peter Doyne in his 53-page opinion stated he would prefer the developer, the NFL franchises that play at the adjoining MetLife Stadium, and state officials attempt to work out a compromise.
“This case is a matter of significant public interest,” Doyne stated. “As such, the parties are encouraged to proceed to mediation in good faith and, hopefully, will be able to resolve any differences that may exist.”
The judge criticized the sports authority for seeking to have the case dismissed based on the agency's finding that an amended master plan for the American Dream project to add 639,000 square feet to the property would not have an “adverse effect” during football game days, according to The Record.
“Regardless of the NJSEA's impressive linguistic gymnastics, such sophistry cannot be countenanced,” Judge Doyne wrote. “The NJSEA does not have the authority to bind this court to a legal determination regarding a breach of the NJSEA's own contract.” See story in The Record.
