CHICAGO-The owner of the site where the city wants to build a new 1,200-room Marriott Marquis convention hotel has filed suit to block the project.
The site owner, 121 E. Cermak LLC, an entity led by construction executive James McHugh, instead hopes to build a six-story data center on the property, according to the litigation filed in Cook County Circuit Court on Monday. McHugh and the city have been in purchase negotiations for the property. The Chicago City Council has also authorized an eminent domain lawsuit, however, the city has not filed any litigation as yet concerning the property, according to the Chicago Tribune.
McHugh's lawsuit asks the court to compel the city to complete its review of applications for permits for the data center project. It charges that the city does not have the right to hold up the approval process for the data center because it wants McHugh to sell the property to the Metropolitan Pier and Exposition Authority for the hotel project.
