DUMONT, NJ-The Borough Council approved measures on Tuesday to become compliant with state affordable housing mandates under the cloud of a remedy lawsuit filed by a developer.
The lawsuit filed by Landmark Dumont LLC, which filed plans to build an apartment development at the former D'Angelo Farms property, claims Dumont unlawfully restricted opportunities for the construction of low- and moderate-income residences. The litigation filed on Feb. 4 seeks to have the court force Dumont to rezone the seven-acre farm for "inclusionary" development, according to The Record.
"I feel like the borough has done everything that it legally is required to do, to be in compliance with its obligations, statutorily and constitutionally, as far as affordable housing goes," Borough Attorney Gregg Paster said at yesterday's council meeting.
