PENNS GROVE, NJ-Legislation has been introduced in Delaware to allow floating gambling palaces of 1,000 or more slot machines and video lottery terminals almost anywhere in that state. Currently, such facilities are allowed only at Delaware’s three racetracks. What does this have to do with New Jersey? One of the new facilities could be legally located in Delaware–but physically attached to the Garden State.

Because of unusual laws dating to the Colonial era, the border between Delaware and New Jersey is the New Jersey shoreline of the Delaware River–all of the river lies in Delaware. New Jersey has tried to get that changed several times with no success, but until now it’s only mattered in things like fishing licenses. (If one wants to drop a hook into the river from the New Jersey shoreline, one has to get a Delaware fishing license and adhere to the state’s rules.)

Officials in this riverfront town, which lies across from Wilmington, DE, are doing a $24 million redevelopment project (Penns Grove native Bruce Willis was involved for awhile), and they want a gaming barge as part of it. Town officials have been talking to an unnamed developer about taking advantage of Delaware’s legislation–if it passes as expected–by mooring a gaming barge at a proposed marina. In New Jersey, casinos are allowed only in Atlantic City, of course, and because of the unusual border law the new facility would be legally in Delaware, but attached to New Jersey.
