BELLINGHAM, MA-The town’s zoning board of appeals made what many consider an odd ruling in its decision to grant a special permit to the Bevilacqua Paving Company to build an asphalt plant but to deny it a zoning variance for the air-filtration tower.

The Medway, MA-based company wants to build the plant on a on a five-acre parcel it owns on Maple Street between Mechanic Street and the Conrail tracks in an industrial zone. “It’s an odd issuing,” a representative of the town, tells GlobeSt.com. “Usually they deny or grant the whole project. I’ve never seen this before.”

In its ruling, the board says that the facility will be a “social and economic benefit to the Town of Bellingham,” noting that it will generate significant tax revenues and that it is located in an industrial area. But the company wanted to build a tower higher than 45 feet, the maximum height allowed in town. The zoning board denied a variance that would allow the company to go forward with those plans.

The town representative adds that Bevilacqua intends to build the tower at the height allowed. The plant will be used to make cement for the company.
