NEPTUNE, NJ-More than a year ago, local developer JEB Brook LLC got planning board approval to develop a 192-unit apartment complex on a 20-acre site here, and barring a further appeal will finally get a chance to move forward with it. Superior Court judge Robert O’Hagan has rejected an appeal to overturn the board’s approval, which had been challenged on procedural grounds.

The case was brought by a local group called the Keep Neptune Green Team, a year-old organization formed largely because of what its founders, Michael Golub and Charles Demaria, charged was a flawed approval process. The group asserted that the time allotted for public comment on the project was insufficient.

Judge O’Hagan disagreed. Also part of the scenario was the fact that the Woodlands project, as it is being called, didn’t need any variances or waivers, and also met all of the zoning requirements.

JEB Brook’s project will be configured as nine three-story buildings, according to the company’s site plan.
