ATLANTA-Emory Morsberger, the Liburn-based developer who never takes no for an answer, has overcome Gwinnett County commissioners’ repeated objections to his planned estimated $100-million mixed-use venture on Highpoint Road in suburban Snellville.

The project, Mountain View Village, will house 170,000 sf of retail, 135 townhouses, 33 detached single-family homes and 20 live-work loft units. The enterprise is expected to break ground next week after Morsberger’s crew demolishes eight dilapidated structures on a blighted 40-acre strip on US 78, about seven miles from Downtown Atlanta.

County commissioners voted 4-1 to rezone the site for a mixed-use project after rejecting the same venture in October because of potential school overcrowding from the planned townhomes and single-family residences. In June, Morsberger sued the commissioners in state Superior Court in Atlanta and won the right to a new hearing. But commissioners again balked at reviewing the developer’s application and reset the hearing to Jan. 25, 2005. They changed their minds, however, when the Gwinnett County Planning Commission approved the project last week, then passed the ball to the commissioners, area brokers familiar with the project tell GlobeSt.com.

One of the Atlanta area’s high-profile developers, Morsberger won headlines recently when the City of Atlanta selected his team over two over prominent finalists to purchase and redevelop the two-million-sf, 75% vacant, 77-year-old former Sears Roebuck Co. catalog warehouse on Ponce de Leon Avenue. The city is negotiating the final purchase price with Morsberger.
