Marion County Circuit Court Judge Paul Lipscomb issued a temporary injunction last month that blocked the measure from taking effect in response to opponents who are challenging the measure's constitutionality on technical grounds. A trial is scheduled to begin Feb. 6.
The petitioners, two women who say they have legitimate claims under the measure, engaged the high court in an effort to overturn Lipscomb's decision. Their argument was there was no other option for a speedy and adequate remedy to their situation.
