The lawsuit, which was filed by Robert Simmons in late 2001, challenged the San Diego City Council's final authorization to issue bonds for the Ballpark Redevelopment Project. Simmons, along with another plaintiff, Gardner Osborne, contended that the city's action regarding the bond issuance was invalid because it violated the limitations imposed by Proposition C, authorizing the city's participation in the project.
In response, the city filed for an expedited trial, stating that financing for the city's contribution to the redevelopment project must be obtained by February 14, 2002 for the construction of the ballpark to resume. The court granted the city an expedited trial, prompting Simmons to drop out of the lawsuit. Osborne, however, pressed forth with the trial, which has recently concluded in favor of the city.
"The legal battle is finally over," says city attorney Casey Gwinn. "After 16 lawsuits and years of appellate court rulings, our legal team has been successful. It is finally a complete clean sweep for the city in defending the Ballpark Redevelopment Project."
