The case was brought by a local group called the Keep Neptune Green Team, a year-old organization formed largely because of what its founders, Michael Golub and Charles Demaria, charged was a flawed approval process. The group asserted that the time allotted for public comment on the project was insufficient.

Judge O'Hagan disagreed. Also part of the scenario was the fact that the Woodlands project, as it is being called, didn't need any variances or waivers, and also met all of the zoning requirements.

JEB Brook's project will be configured as nine three-story buildings, according to the company's site plan.
