PHILADELPHIA-There has been a settlement  in the longstanding legal battle between the city and the Cradle of Liberty Council concerning its headquarters on city-owned property at 22nd and Winter streets.

The staff of the Cradle of Liberty-Boy Scouts of America will leave the building by June 30 and its retail store will vacate October 31, according to the Philadelphia Business Journal. The city will reimburse the organization $825,000 for capital improvements it made over the years to the building that was constructed by the Boy Scouts in 1928.

The litigation stemmed from the city's decision to charge a higher market rent rate for the property when the Boy Scouts explicitly banned gay members. Previously, the city had allowed the organization to lease the land where the headquarters stands at $1-per-year, given its charitable and nonprofit status. The Scouts filed suit against the city and in 2008 a judge ruled in favor of the Cradle of Liberty. The city had filed an appeal of that ruling. See story in the Philadelphia Business Journal.
