In an unusual ruling, a Superior Court judge here has effectively killed an initiative aimed at forcing the City of San Clemente to extend a key thoroughfare before thousands of new homes and commercial projects could be built. Judge Tam Nomoto’s ruling didn’t explain why she ordered the initiative removed from the ballot. A more detailed decision is expected soon.

Three local residents had collected nearly 2,800 signatures to qualify the measure for a November vote. The proposition would have effectively forced city officials in San Clemente to extend Via La Plata by about three miles-all the way to Ortega Highway-before any new commercial or residential construction in the area could commence.

Supporters of the initiative say traffic in the area is growing worse every month, and that Via La Plata must be extended to avoid an all-out gridlock.
