Residents of the adjacent Garden Hills neighborhood had hoped tostop construction on the five million-sf project which includesoffices, retail and residential development.

The neighborhood suit, filed against the City of Atlanta andMARTA, which is leasing the three acres for the office towers,contends MARTA is violating state law by using public money to helpclear its property and help private development.

MARTA has earmarked $40 million to prepare the property atLindbergh, site of a rapid rail station and MARTA headquarters. Thesuit contends the project will affect the neighborhood negativelywith traffic congestion.
