BOSTON-A judge here has invalidated the state’s Department of Telecommunications and Energy’s access regulations, finding that they constitute an unlawful taking of private property.

The DTE’s regulations dictated certain terms by which property owners would be required to accommodate telecom carriers seeking access to their buildings. Any telecom service provider would be allowed to enter every privately owned, multi-tenanted building in the state to install their own wiring and equipment for little or no cost.

The National Association of Industrial and Office Properties along with the Greater Boston Real Estate Board and the Massachusetts Association of Realtors lobbied against the regulations. NAIOP’s website’s states that the regulations “would create an expensive, cumbersome, unworkable bureaucracy funded by taxpayer dollars, and ultimately stifle competition for telecom choice.”

David Begelfer, president of the local chapter of NAIOP tells that DTE has appealed the ruling and they are still waiting for the results of that appeal.
