On Dec. 21 the Bureau of Indian Affairs issued a "Finding of NoSignificant Impact" on the $600-million project to be built onproperty adjacent to Monticello Raceway by the St. Regis MohawkTribe in partnership with Empire Resorts Inc.

Spitzer must sign off on a concurrence of the Fonsi. After thathas been secured, the Department of Interior's agreement to takethe Monticello property into trust for the tribe is the lastregulatory step before the project can break ground. Now, notunexpectedly, the casino venture must now clear a legal hurdle aswell.

A spokesperson for the National Resource Defense Council saysthat although the suit was filed in Manhattan, the case will betried before US District Court Judge Charles Brieant in federalcourt in White Plains.
