OWINGS MILLS, MD-Solo Cup Co.'s lawsuit against the developers of the proposed Foundry Row project here over terms of a sublease on an energy plant adjacent to the former Solo Cup factory is headed to mediation.
The energy plant provided electricity to the Solo Cup factory and contained equipment that the firm leased through 2017. Once Solo Cup sold the 1.8-million-squqare-foot property in 2011 and later abandoned the plant, it subleased the equipment to shopping center developers Greenberg Gibbons Commercial Corp. and Vanguard Commercial Development Inc. with an agreement that rent would continue to be paid and the equipment would be maintained, according to the Baltimore Business Journal.
Greenberg Gibbons and Vanguard Commercial began demolition this past April on the Solo Cup property and plan to build a $140-million retail-office development at the site located at Reisterstown and Painters Mill roads that will be anchored by a Wegmans Food Market.
The Foundry Row developers and Solo Cup are scheduled to enter private mediation on Sept. 16.
Court documents reveal allegations of damage at the energy plant and disputes over inspections and the party responsible for maintenance of the plant. Greenberg Gibbons and Vanguard stopped paying rent on the equipment because they felt Solo had breached its lease. See story in the Baltimore Business Journal.
