NEW YORK CITY-The Tenant Protection Unit, formed by New York Gov. Andrew Cuomo last year to investigate housing fraud and protect tenant rights, is undertaking a very aggressive investigative policy that has some New York City building owners crying foul.

The Tenant Protection Unit has conducted audits that have required landlords to turn over documentation as to why they removed apartments from the rent-stabilization program and in some cases has issued subpoenas covering the entire operations of some building owners.

While tenant advocacy groups hail the unit's work, building owners charge it is making decisions outside the rules and appeals process of the state Division of Housing and Community Renewal, according to the Wall Street Journal.

"A landlord can never win," says Adam Leitman Bailey, an attorney who represents building owners and tenants. "They have to spend huge amounts of money on legal fees, and even if they win they can't brag about it, because it will still hurt the landlord's reputation." See story in the Wall Street Journal.
