MAHWAH, NJ-The owners of approximately 160 affordable housing units here have filed suit against the township charging that the rules governing sales of the units in the original master deed were changed.
The plaintiffs in the lawsuit filed on Dec. 18 own units in the Society Hill at Kilmer Woods Village I, Village II, Village III, Ridge Gardens and Franklin Heights developments in Mahwah.
The litigation stems from a letter sent by the municipality this year stating that the Mahwah township would receive 95% of the proceeds from the sale of the units if they were sold at market value to buyers not subject to income restrictions, according to The Record.
“The plaintiffs believed they had an agreement with the municipality that at the end of the 25 years they would be able to sell their units to anyone, and the municipality is attempting to violate that agreement,” said Stephen Eisdorfer, an attorney representing the homeowners.
Andrew Fede, the township's attorney, said he could not comment on the lawsuit since he had not seen it as yet. See story in The Record.
