AUSTIN-The Austin Board of Realtors has to share, says a federal judge, who lifted an injunction to give e-Realty Inc. access to MLS listings for on-line posting of their properties in the region.

The decision results from a lawsuit filed by the city’s realtors association, which claimed its policy didn’t allow MLS posting on the private on-line residential real estate brokerage firm. The realtors board has changed its policy–in line with the National Board of Realtors proviso–since filing the lawsuit in March.

Federal District Judge James Nowlin will preside over a meeting Monday when the parties willdecide whether to proceed with the lawsuit or seek a dismissal. More than a month ago, Austin’s realtors board asked the court to drop the injunction and dismiss the case because it altered its policy in late May.
